Señores Participantes: We hereby inform you that AGROSUPER S.A., controller of EMPRESAS AQUACHILE S.A., gave notice to the securities market upon compliance with the corresponding legal requirements of its right to purchase shares, which is established in Article 71 bis of Law 18,046. Accordingly, 15 days after such notice (March 21st, 2019) the issuing company, EMPRESAS AQUACHILE S.A., must register under AGROSUPER S.A.’s name all the shares (of its remaining shareholders) that have been acquired after March 11th, 2011. The foregoing does not require the parties to sign any transfer. Thus, the sale proceeds will be immediately available to the shareholders according to what is provided for the distribution of dividends. In accordance with the foregoing, we request Depositors that hold shares on deposit (issued by EMPRESAS AQUACHILE S.A) to withdraw those securities as soon as possible. Notwithstanding the foregoing and given that the regulations established in Law 18,876 indicate that DCV must not register transfers or record new transfers of securities if they are subject to limitations or encumbrances, and considering said provisions only allow depositors to perform transfers of securities operations in the system, it has been decided to submit a request to the Commission for the Financial Market. The foregoing in order to authorize DCV to act as an agent and perform these withdrawals (in cases where the voluntary withdrawal has not been made) submitting the relevant securities to the issuer, in order that shareholders can exercise their rights. Finally, we inform you that we have initiated the corresponding contacts with the Securities Exchanges for the purpose of agreeing on a procedure for these cases.
