Dear Participant
We inform you that through Decree 955 of August 25, 2010 of the Treasury Department, published in the Official Gazette of February 14, 2011, the Decree 734 corresponding to the Law Regulation 18.876 about Securities Deposit, which text is attached to this circular, has been modified.
Among the topics subject to modifications stand out:
Rates:
They can be established in the Internal Rules of the DCV if not done in the deposit agreement, establishing that any modification regarding remunerations must be informed to the depositors at least 30 days prior to their implementation.
Position Certificates:
May be requested electronically.
Certificates for attendance to Board Meetings and exercise of other rights:
It is specifically considered that they may be issued for the depositors’ mandates that have individual accounts.
Asambleas de Depositantes:
Regarding the quorum to perform the depositors Assembly, the modification allows that these constitute in first summons with depositors that represent, at least, 50% of the total amount kept on deposit.
In cases where the depositors specifically authorize it in writing, the notice of summons may be sent electronically.
Use of electronic means:
Regarding communications and requests authorized to be sent electronically, the technical rule about security and confidentiality of the electronic document that is in force for the organs of the State Administration, in terms of the article 6 of the Supreme Decree 83 of 2004, applies.
The DCV invites its participants to take notice of the new rules, for which the updated version of the Rule is already available in the Web page of the society, www.dcv.cl.
