Depósito Central de Valores S.A. (DCV) advises that according to the regulations of article 14 of Law 18.876, it offers the Depositors the new service of Electronic Register of Liens and Releases, for which conditions of operation and functionality are described in the Internal Regulation of the Company and the respective Operational Guide.

In the initial stage the service is directed to the transactions between the depositors and their clients (whether they be those who operate individual or joint accounts). The depositors who wish to make use of the new service must advise DCV using the Register of Depositors Form, FRD, keeping in mind that:

1)-The Electronic Register of Liens Service has, and will have, as its exclusive purpose the replacement of the notary notification process provided for in Article 14 of Law 18.876, being the responsibility of the depositors to comply with the formalities of incorporation of each guarantee according to the legislation applicable to them, in order that they are legally incorporated and have full judicial and extrajudicial effect.
2)-Because they are liens incorporated by the clients or in favor of them, considering that “DCV” does not have, and will not have relation with them, the “depositor” will have total responsibility for:

a).Having the authorization from their respective client to perform the electronic communications with “DCV” for themselves and for the mandate.

b).Verifying the legal capacity and identity of those who granted the authorization mentioned above, making use of the service only in the cases where they have the authorization mentioned above. 

c).They does not correspond with “DCV” to verify if the lien, or where appropriate, the release, have the due backups for their registration and electronic processing, and they will act according to the communications that the depositors convey to it (be it of incorporation of the lien and/or release).
